By placing an order, you agree that the sole and exclusive maximum liability to us arising from any product sold on this website shall be the price of the product ordered. In no event shall we be liable for special, indirect, consequential, or punitive damages related to product sold.

Except in respect of death or personal injury caused by our negligence, under no circumstances whatsoever shall we be liable to the buyer for any loss or damage whatsoever (including but not limited to loss of profit or the loss of any other form of financial or non-financial benefit; loss of use of or damage to any property; work stoppage; any special, indirect, incidental or consequential loss or damage; costs; expenses; and other claims for compensation), arising out of or in connection with the sale of any of our products (including any misrepresentation, unless fraudulent); any breach of an implied or express warranty, condition or other term; (or any breach of a common law duty), in an amount exceeding the price of the product giving rise to the claim, except as expressly agreed in writing by us.

BATTERY DISCLAIMER & LIMITATION OF LIABILITY:

EXTREME RADIO CONTROL checks both the individual cell voltages and the battery pack voltage for every Lithium Polymer battery pack before we send them out. EXTREME RADIO CONTROL then warrantees all packs to have proper assembly and cell voltage at time of purchase. In the event that a customer finds defects in materials or assembly workmanship when the goods are received but unused, EXTREME RADIO CONTROL will replace such packs within Australia after inspection if they are deemed to be faulty.

EXTEME RADIO CONTROL does not offer a general warranty for battery packs which have already been charged and discharged, or for which claims are made more than one week after receipt of said battery packs by the customer. Because the majority of Lithium Battery problems occur after initial use and are due to over charge/discharge of the packs, it is in most cases difficult to determine the cause of failure, and requires inspection by the manufacturer.

For packs that have been used and which the customer believes are defective, EXTREME RADIO CONTROL & their manufacturer have agreed to have these inspected at the factory, and replaced factory direct if defects are found. In the event that the pack is found not defective or has been damaged by misuse, the pack may be returned to the customer if desired, at the customer's expense.

All batteries sold by Extreme Radio Control were designed for applications other than radio controlled vehicles. When used in radio controlled vehicles, discharge rates often exceed the manufacturers maximum design specifications. Therefore, the use of any battery sold by Extreme Radio Control for radio controlled use should be considered experimental. No warranty, expressed or implied, by the manufacturer, distributors or retailers with respect to capacity, life in cycles, storage or discharge characteristics is available.

Certain motor, propeller or gearbox combinations, as well as excessive charge rates, may create conditions that exceed the design limitations of the cell. In addition, spinning motors and propellers, and flying model airplanes create the potential for serious injury to persons and property. Therefore, it is incumbent upon the purchaser of any of Extreme Radio Controls products to use prudent safety precautions and follow all manufacturer's manuals and guidelines along with the relevant laws governing the usage of radio control vehicles in your State.

When placing an order with Extreme Radio Control, either via online, e-mail, fax or phone, the purchaser and user agrees to accept responsibility for all risks posed by our products and to not hold Extreme Radio Control, the manufacturer, distributors or retailers - (including all owners and employees) - responsible for any accident, injury or death to persons or damage to property.

Extreme Radio Control cares about SAFETY and encourages all customers to exercise sound judgment in the building and operation of all RC vehicles. All customers should check the laws with their local council or government body before operating a radio controlled vehicle in a public place.

WARRANTY:

All our products sold are warranted for 30 days to be free from manufacturer defects. Some products have a 12mnth factory backed warranty such as ERC, LIGHTNING, Hyperion, HET, ARC, Wemotec, Skyworld. Please enquire at time of purchase if you wish to know more about the warranty on a particular product. We will adhere to Australian warranty conditions on all new products deemed faulty at time of manufacture, products that have been used are not covered under statutory warranty

Extreme Radio Control shall not be held in any way liable to the buyer under this clause unless the conditions of use and installation are complied with. Warranty will only be valid if the following conditions are followed.

• The product is installed following the manufacturers recommendations.
• The product is used under normal operating conditions for which it was designed.
• The product receives proper maintenance if required.
• The product has not been subject to any modifications other than those approved of in writing by the manufacturer or Extreme Radio Control.
• The product has not been used in conjunction with or installed with any unauthorized equipment.
• Lithium polymer products are to be charged using approved battery chargers and used in accordance with supplied operating instructions.

All Extreme Radio Control products are guaranteed at the time of shipping to be in new condition. The customer takes responsibility for the product being insured at the time of shipping. Insurance is arranged at the request of, and cost to the customer. Claims for items broken in transit shall be dealt with by the customer.

RETURNS:

Any products returned to Extreme Radio Control for a warranty claim shall be at the cost of the buyer. The customer must contact Extreme Radio Control to obtain a return authorization before sending any products back otherwise we will accept no responsibility for the returned items. Goods must be well packed, any damages occurring during return are not the responsibility of Extreme Radio Control, the customer must ensure he/she insures the item/s being returned.

Goods being returned for credit/refund must be in their original packaging and in as new unused condition, batteries must be returned with all original packaging and paperwork for verification that they have not been charged/used. It is at the discretion of Extreme Radio Control to accept returns based on our inspection of returned goods. A restocking fee of 20% applies to any goods that are returned for refund.
